The Killer Four

One of the best ways to address federal and state compliance requirements is to start with an understanding of the target areas of enforcement by regulators and inspectors and why these are target areas.OUCH!! Compliance in four key areas is crucial to avoid catastrophic injuries as well as costly fines, citations and criminal charges.

In this post, I am not going to refer to any particular regulation or statute. These four general categories cover many, many state and federal regulations. Trainers and inspectors categorize many regulations and standards into four compact categories and focus their attention on these general categories because these accidents cause 90% of construction fatalities. Called “The KILLER FOUR,” they are:

  1. FALLS – Falls from elevation continue to be the biggest source of catastrophic injuries to construction workers. Falls account for nearly one-third of construction fatalities.
  2. STRUCK BY – 22% of construction fatalities are the result of being “struck by” a falling and/or moving object.
  3. CAUGHT IN/BETWEEN – This category includes cave-ins, trenching accidents and being pinned by machinery or supplies. 18% of fatalities occur in this manner.
  4. SHOCK – 17% of all fatalities are because of an electrical accident.

These “Killer Four” were developed after a 10-year study by the Occupational Safety and Health Administration and published in 1990.

Based in part on that study, OSHA inspectors and regional offices began target enforcement programs into specific construction trades and sites in their region where these “Killer Four” are regularly found. OSHA has determined that violations in these four areas are a top priority.

Foreclosure Scams

When faced with foreclosure, you may be desperate to try any solution.

More often then not, the solutions offered by some foreclosure solutions companies are scams. These companies prey on desperate people and take advantage of them knowing that, in most cases, they cannot fight back.

The Ohio Attorney General offers this list to consider before you use anyone to address your foreclosure issue:

  1. Don't panic. Get detailed information about the deadlines you face in resolving your problems. Pay special attention to the date on which you would lose legal right to ownership of your home.
  2. If you have a pending lawsuit against you for your home you can contact legal aid or the bar association to find an attorney to represent you.
  3. If you are getting foreclosure threatening letters but are not yet in a lawsuit contact a certified HUD counselor for assistance.
  4. Be wary of any claim to stop foreclosure for a fee.
  5. Never sign a contract under pressure. Take your time and consult a lawyer, if possible.
  6. Never make your mortgage payments to anyone other than your lender. If you can't pay, do not ignore warning letters from your lender; contact them immediately to work out payment arrangements.
  7. Don't sign anything with blank lines or spaces; information could be added later without your knowledge and consent.
  8. Call the Better Business Bureau and the Attorney General’s office to see if there are any complaints against the company before you use them. Contact the AG’s office at www.ag4ohio.gov or by calling 1-877-AG4OHIO.
  9. If you do not speak English, never use a company’s translator. Instead, insist on using your own.
